This privacy policy describes the personal data collected or generated (processed) when you use David Ramzy’s websites (Sites). It also explains how your personal data is used, shared and protected, what choices you have relating to your personal data and how you can contact us.

David Ramzy Pty Ltd ACN 669 411 358 (David Ramzy, also referred to as “our”, “we” or “us” in this privacy policy) is an Australian entity. David Ramzy is responsible for processing the personal information that we collect from you when you interact with us.

WHAT PERSONAL DATA DO WE COLLECT AND WHEN?

We ask you for certain personal data to provide you with the products or services you request. For example, when you make purchases, contact our customer service team, request to receive communications, create an account, participate in our events or contests or use our Sites.

The personal data that we collect about may include:

  • your contact details including name, email, telephone number and shipping and billing addresses;
  • login and account information, including screen name and unique user ID;
  • your purchase history with us; 
  • other personal details about you including gender anddate of birth;
  • payment or credit card information;
  • images, photos and videos that you tag us in on social media or that you send to us by any electronic means;
  • data on physical characteristics, including ring size and bangle / cuff size; 
  • personal preferences including your wish list as well as marketing and cookie preferences;
  • if you interact with us via a social media platform, we will collect data you provide us via that platform;
  • we collect certain information automatically about visitors to our Sites, described in the section headed "Cookies and other information that we automatically collect", below; and
  • information about your location to the extent that we provide any location services, described in the section headed “Location services” below.


HOW CAN YOU MANAGE THE DATA WE COLLECT FROM YOU?

In many cases, your web browser will provide tools to allow you to control when your device collects or shares particular categories of personal data. For example, your mobile device or web browser may offer tools to allow you to manage cookie usage or location sharing. We encourage you to familiarize yourself with and use the tools available on your devices.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We will use the personal information we collect from you to:

  • manage and fulfill purchase and repair orders, facilitate delivery, and to provide after-sales services;
  • manage our accounts and records;
  • deal with your enquiries and requests;
  • send service related communications, including announcements and administrative messages such as order confirmation;
  • identify products and services we think you might be interested in based on your information, such as your purchase history and your previous interactions with us;
  • where you have consented to review the same, send you marketing communications (including e-mails and social media audience matching) relating to us and other third party partners and that we think may be of interest to you where we have a legitimate basis to do so;
  • conduct market research so that we can continuously improve the services we provide to our customers;
  • understand how our Sites are used so that we can continuously improve our Sites and services and other offerings; 
  • we may also use your personal data to prevent or detect fraud, abuse, illegal use, violations of our Terms of Use, and to comply with court orders, governmental requests or applicable law.

COOKIES AND OTHER INFORMATION WE AUTOMATICALLY COLLECT

Like most platforms, David Ramzy logs IP addresses and uses cookies and similar technologies that allow us to recognise you and to customise your experience, and provide us with information about the way our visitors access our Sites. 

David Ramzy's website uses cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages via SMS.

Cookies are text files, containing small amounts of information, which are downloaded to your computer or mobile device when you visit a website or mobile application. They are used to recognise your computer as you move between pages on a website, or when you return to a website or mobile application you have visited previously. Cookies are widely used in order to make platforms work, or to work more efficiently, as well as to provide information to the owners of the platform. 

We use cookies to enhance the online experience of our visitors (for example, by remembering your language and/or product preferences) and to better understand how our Platform is used. Cookies will tell us, for example, whether you have visited our Platform before or whether you are a new visitor. They can also help to ensure that adverts you see online are more relevant to you and your interests.

There are two broad categories of cookies:

  • First party cookies, served directly by David Ramzy to your computer or mobile device. They are used only by David Ramzy to recognise your computer or mobile device when it revisits our Platform. 
  • Third party cookies, which are served by a third party service provider on our Sites, and can be used by the service provider to recognise your computer or mobile device when it visits other platforms. Third party cookies are most commonly used for platform analytics or advertising purposes.

Cookies can remain on your computer or mobile device for different periods of time. David Ramzy uses both 'session cookies' and ‘permanent cookies’. Session cookies exist only while your browser is open and are deleted automatically once you close your browser. Permanent cookies survive after your browser is closed, and can be used to recognise your computer or mobile device when you open your browser and browse the internet again.

HOW TO CONTROL OR DELETE COOKIES

We use non-essential cookies on the basis of your consent. You have the right withdraw that consent and refuse the use of cookies at any time and we have explained how you can exercise this right below. However, please note that if you choose to refuse cookies you may not be able to use the full functionality of our Sites. 

You can set your cookie preferences by changing your browser settings so that cookies from our Sites cannot be placed on your computer or mobile device. In order to do this, follow the instructions provided by your browser.


SHARING YOUR PERSONAL INFORMATION

We will only share personal information about you with other people or non-affiliated companies under the following circumstances:

  • we will disclose your personal information to third party providers for the purposes of providing online and other payment services, handling credit checks and fraud prevention, postal / delivery services and any other services required in order for us to use your information for the purposes specified in the section entitled “How do we use your personal information?””;
  • we will disclose your personal information to any law enforcement agency, court, regulator, government authority or other third party where we believe this is necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights or the rights of any third party; and
  • we will disclose your personal information to any third party that purchases, or to which we transfer, all or substantially all of our assets and business. Should such a sale or transfer occur, we will use reasonable efforts to try to ensure that the entity to which we transfer your personal information uses it in a manner that is consistent with this Privacy Policy.

We may share your personal information to companies related to David Ramzy (for example subsidiaries, parent company or subsidiaries of our parent company). 

The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties


PROTECTING YOUR INFORMATION 

We want you to feel confident about using our Sites, and we are committed to protecting the personal information we collect. We limit access to personal information about you to employees who reasonably need access to it, to provide products or services to you or in order to do their jobs. We have appropriate technical and organisational physical, electronic, and procedural safeguards to protect the personal information that you provide to us against unauthorised or unlawful processing and against accidental loss, damage or destruction. However, where we ask you to choose a password in order to access certain parts of our Sites, you are responsible for selecting a secure password and keeping that password confidential. You should choose a password which you do not use on any other site, and you should not share it with anyone else.

MOBILE TERMS OF SERVICE

The David Ramzy mobile message service (the "Service") is operated by David Ramzy. Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to David Ramzy’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of David Ramzy through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with David Ramzy. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to DavidRamzy or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other David Ramzy mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.


CHANGES TO THIS POLICY

We may update this privacy policy from time to time (without notice) in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
